Terms and Conditions – Project Laut Diving
1. Agreement, Acceptance, and Scope
These Terms & Conditions apply to all services provided by Project Laut Diving (“we”, “us”, “our”, “the Company”) including, but not limited to: scuba diving, snorkelling, boat trips, training courses, guided dives, equipment rental, and any related logistics or surface support.
By booking any activity with Project Laut Diving—whether online, by message, by email, by phone, through an agent, or in person—you (“Guest”, “you”, “your”) confirm that you have read these Terms & Conditions and that you unconditionally agree to be bound by them.
These Terms & Conditions are intended to set clear expectations about booking confirmation, payments, cancellations, refunds, rescheduling, insurance requirements, health screening, operational modifications, and liability allocation.
2. Guest Statement of Agreement (Assumption of Risk & Release)
By participating in any activity arranged, organised, or conducted by Project Laut Diving, you certify and acknowledge all of the following:
2.1 Fitness and Training
Your acceptance on any scuba diving and/or snorkelling program is conditioned on your assurance that you are physically fit to participate. Where training is required (for example, courses or supervised entry-level programs), you will receive appropriate instruction and agree to follow all standards, briefings, and instructions.
2.2 Inherent Risks
You understand that scuba diving, snorkelling, and boat operations involve inherent risks that cannot be eliminated, including but not limited to: currents, waves, surge, weather changes, marine life, boat movement, remote-location constraints, equipment malfunction, physical exertion, and the possibility of serious injury or death.
2.3 Release and Discharge
In order to be accepted as a Guest, you release and discharge Project Laut Diving, its owners, employees, instructors, divemasters, crew, agents, contractors, and other Guests from any and all claims for damages resulting from death or personal injury (including loss of services) arising out of or in connection with your participation in the activities, and/or the ownership, maintenance, use, or operation of any vehicle, vessel, watersport equipment, or other devices involved.
2.4 Operational Changes
You understand that the remoteness of Nusa Penida and its surroundings, local customs, marine conditions, and/or weather may require modification of activities. Project Laut Diving reserves the right to modify, postpone, or cancel any activities at any time due to unfavourable conditions and/or technical difficulties.
2.5 Damage to Property
You agree to compensate Project Laut Diving at full current market value for any loss of or damage to Company property or equipment resulting from abuse, misuse, or negligence on your part (normal wear and clearly visible wear-and-tear excluded).
2.6 Compliance with Rules
You agree to comply strictly with reasonable terms, rules, and safety instructions issued by staff during the course of the activities.
3. Proof of Certification (For Certified Diver Activities)
For any certified scuba diving activities, you must present your most recent certification card or digital proof at registration/check-in.
- If you cannot show proof of certification, you may be unable to participate. This does not constitute grounds for a refund.
- You are responsible for ensuring you are suitably qualified for the dives/activities booked, including depth limits, environmental conditions, and training prerequisites.
- We accept certifications from recognised agencies (including but not limited to SSI, RAID, CMAS, BSAC, SDI, NAUI, and equivalents). If in doubt, contact us before booking.
This certification requirement does not apply to entry-level training programs where certification is not required (for example: Open Water training, and supervised introductory experiences that are delivered according to training standards).
4. Payment Policy (Booking Confirmation)
4.1 Payment in Our Office (In-person)
Full payment (cash or card) is due prior to engaging in any activities. Boat seats and bookings are only held, and the booking is only considered confirmed, once full payment has been received.
4.2 Payment for Online / Remote Bookings
To confirm a booking and allow us to hold your seat(s) on our boats, full payment must be received no later than 48 hours prior to the agreed start date/time of the booked activities.
If full payment is not received within this time, Project Laut Diving reserves the right to release and resell seats and activities.
4.3 Non-Payment and Certification Processing
We reserve the right to suspend, reschedule, and/or cancel any course, program, or dive service, and/or to withhold certification processing until payment is received in full.
4.4 Professional Course Deposit
For Professional Training Courses, a 50% down payment is due before the course begins. Payment instructions for the remaining balance will be issued by email.
5. Discounts
5.1 Early Bird Discounts
“Early Bird” bookings are bookings paid in full 60 days or more prior to the start of the booked activities and qualify for an additional 5% discount.
5.2 Group Discounts
“Group” bookings are bookings made for 4 or more Guests booking the same activities and qualify for an additional 5% discount.
5.3 Discount Cap
Discounts may be accumulated up to a maximum of 20% of the activities’ base rates.
6. Cancellation & Refund Policy
6.1 Valid Cancellation Methods (Required)
Cancellations will only be acknowledged if received:
- In writing by email to info@nusapenidadive.com with the subject line clearly starting with “cancellation”, or
- In writing via WhatsApp: +62 813-3065-8826, or
- In person directly to the management team at our office.
No cancellations are accepted by any other means. Cancellations must be received during office hours, in time, and must be approved by Project Laut Diving to be valid.
Important: Special cancellation and refund conditions apply to “Early Bird” and/or “Group” bookings (see below).
6.2 Standard Bookings (Non-Early Bird and Non-Group)
a) Cancellation at least 36 hours before start (during office hours)
If you contact us during office hours and at least 36 hours before the start time of the booked activities, we will do our best to reschedule your booking if you wish.
- If we allow rescheduling, the rescheduled activities must take place no later than one (1) month after the initial booking date.
- Additional charges may apply where rescheduling causes extra costs (for example, transport changes, supplier charges, operational constraints, or other added expenses).
If you do not wish to reschedule, cancellations received at least 36 hours before start qualify for a refund, minus:
- any fees already paid to third-party providers (including but not limited to training agency fees such as SSI),
- a IDR 250,000 administrative fee, and
- any transfer/bank/payment processing fees incurred to issue the refund.
(b) Cancellation less than 36 hours before start
Cancellations received less than 36 hours before start do not qualify for any refund (full or partial) for activities booked with Project Laut Diving.
6.3 Early Bird and/or Group Bookings – Special Conditions
Definitions
- Early Bird: paid in full 60+ days prior to start (qualifies for 5% discount).
- Group: 4+ Guests booking the same activities (qualifies for 5% discount).
These discounted bookings allow us to plan staffing, boat capacity, and operational resources in advance. For that reason, different cancellation conditions apply.
If your booking qualifies for both Early Bird and Group discounts, Early Bird cancellation rules take precedence.
6.3.1 Early Bird Booking Cancellation
(a) Cancelled more than 30 days before start
You qualify for a refund, minus:
- third-party fees already paid (including but not limited to training agency fees such as SSI),
- a IDR 500,000 administrative fee, and
- any transfer/bank/payment processing fees incurred to issue the refund.
(b) Cancelled within the last 30 days but at least 36 hours before start
You will be refunded 50% of the total price paid, minus:
- third-party fees already paid (including but not limited to training agency fees such as SSI), and
- any transfer/bank/payment processing fees incurred to issue the refund.
(c) Cancelled less than 36 hours before start
No refund will be provided (full or partial).
6.3.2 Group Booking Cancellation
(a) Cancelled more than 7 days before start
You qualify for a refund, minus:
- third-party fees already paid (including but not limited to training agency fees such as SSI),
- a IDR 500,000 administrative fee, and
- any transfer/bank/payment processing fees incurred to issue the refund.
(b) Cancelled within the last 7 days but at least 36 hours before start
You will be refunded 50% of the total price paid, minus:
- third-party fees already paid (including but not limited to training agency fees such as SSI), and
- any transfer/bank/payment processing fees incurred to issue the refund.
(c) Cancelled less than 36 hours before start
No refund will be provided (full or partial).
Refund Method and Timing
- Only cash payments can be refunded in cash.
- Payments made by any other means will be refunded by bank transfer (or equivalent) within 30 days of Project Laut Diving’s written acknowledgement of the cancellation.
7. Services Not Used, No-Shows, and Course Non-Completion
No refund or compensation is due for unused activities. This includes, without limitation:
- Guests who do not show up at the agreed meeting time,
- Guests who arrive too late and miss departures,
- Guests who decide not to dive, terminate dives early, or do not complete training/trips for any reason whatsoever.
7.1 Course Completion and Additional Charges
Failure to complete course requirements for any reason attributable to the Guest may result in additional charges to complete the course at a later date. Such reasons include, but are not limited to: illness/unwellness, insufficient water skills, inability to meet performance requirements under training standards, failure to complete academic requirements, or missed sessions.
Additional charges may cover staff time, boat/dive fees, equipment and materials, surface support, vehicle/transport costs, and other operational expenses required to complete training.
7.2 Referral Option
If you are not willing or able to pay additional fees to complete your course, a referral/training record may be issued. Where issued, the referral is valid for six (6) months from the completion date of the last part of your training.
8. Insurance Requirements (What We Expect and What It Means)
8.1 Travel Insurance (Strongly Recommended)
We strongly urge Guests to purchase a fully comprehensive travel insurance policy at the time of reservation. At minimum, your travel insurance should cover:
- medical expenses and emergency treatment,
- accidents and personal liability,
- baggage and personal effects, and
- trip cancellation and interruption.
We also strongly recommend choosing an insurer that covers travel disruption caused by transportation issues (including but not limited to aircraft or ferry cancellations, technical malfunctions, delays), and disruption due to natural events such as volcanic activity, earthquakes, flooding, and severe storms.
Policy consequence: If you are unable to attend your booked activities on the agreed date because of travel disruption or natural events, no refund will be granted by Project Laut Diving under these Terms. Your recourse, where available, is through your insurance provider.
8.2 Diving Insurance (Required)
Having travel insurance is a personal choice. Having insurance that covers the specific activities you engage in—especially scuba diving—is your responsibility and is required.
You agree that:
- you are solely responsible for obtaining insurance covering the activities you book with us (including but not limited to scuba diving), and
- Project Laut Diving cannot be held liable and is not responsible for financial losses, medical expenses, evacuation costs, treatment costs, or any other costs arising from incidents occurring during activities arranged, booked, or performed with us.
Many travel insurance policies include diving coverage or offer it as an add-on. You should confirm the details directly with your insurer before booking.
If you do not have appropriate coverage, we strongly advise you to purchase short-term dive insurance with Dive Alert Network (DAN). We can assist with DAN subscription at our office prior to diving.
8.3 If You Choose Not to Insure
If you choose not to carry travel insurance and/or adequate coverage for your activities, you do so at your own risk. Project Laut Diving will not be responsible or liable for financial loss caused by any reason whatsoever, including missed bookings, medical costs, evacuation costs, or trip interruption.
9. Liability Release & Assumption of Risks (Clear Practical Meaning)
Scuba diving, snorkelling, and boat travel involve risks. These risks exist even when all standards are followed.
Project Laut Diving:
- will not be responsible for personal injury, property damage, or wrongful death that may occur during activities arranged, booked, or performed with us;
- is not liable for accidents resulting from acts or omissions of third parties; and
- is not responsible for loss, theft, or damage to personal items including but not limited to: personal dive equipment, cameras, video equipment, phones, strobes, passports, jewellery, flight tickets, and other valuables.
10. Medical Declarations, Screening, and Clearance
10.1 No Medical Advice
Project Laut Diving is not qualified to provide medical advice. If you are uncertain about a medical matter related to diving or snorkelling, you must obtain advice from a qualified medical practitioner before participating.
10.2 Medical Questionnaire (Mandatory)
For any dive course or diving activity—regardless of prior experience—Guests must complete a medical questionnaire in good faith.
10.3 Fitness Requirement and Practical Consequence
Before participating in activities in remote locations, you should ensure you are reasonably fit. Many of our activities are physically demanding. If you experience discomfort, displeasure, or pain due to your inability to perform an activity, this is not grounds for complaint or refund.
10.4 Disclosure of Conditions and Medication
If you have any health conditions, are taking medication, or have had illness, injury, or surgery that may affect you while diving, you must inform staff in advance.
Failure to disclose relevant information may result in your being refused participation for safety reasons. If we have valid reasons to suspect a potentially dangerous medical condition, we may require you to provide medical clearance before participating or continuing. If clearance is requested and not provided, no refund or compensation will be issued for activities missed.
10.5 Food Allergies and Dietary Requirements
If you are allergic to any medication or have dietary restrictions or food allergies, you must communicate this clearly in writing during the booking process. If not disclosed in advance, it may be difficult or impossible for us to accommodate your needs.
11. Unforeseen Events (Force Majeure)
If departure of a dive trip is not advisable—or may be dangerous to the life or health of passengers or to the vessel—due to conditions including but not limited to: severe weather, perils of the sea, Acts of God, political incidents, or force majeure (including pandemic, tsunami, typhoon, severe storms, earthquakes), the captain has sole discretion to delay or cancel departure.
If such events occur during a trip and returning to port is not advisable, the captain may delay return until conditions allow and adjust the itinerary, including cancellation or re-sequencing of services.
Additionally, in the event of political unrest, military conflict, flight cancellations, or any other risk to Guests or vessels, we may reschedule bookings.
Refund rule: We only refund money where Project Laut Diving itself cancels a trip, except where cancellation arises for reasons defined here as Force Majeure. We accept no financial responsibility for itinerary changes or cancellations caused by circumstances outside our control.
12. Service Modifications and Refusal of Participation
We reserve the right to rearrange the order of an itinerary, cancel or substitute elements, or change sites/times without notice when local conditions, unforeseen events, or technical difficulties require it.
Our dive professionals may refuse or stop a Guest’s participation at their discretion based on safety and conduct, including but not limited to:
- breach of marine park rules/regulations,
- handling or harassing marine life,
- drugs and/or alcohol consumption before or between dives, or
- failure to abide by safe diving practices.
In such cases, no refund will be granted for missed dives and/or activities.
13. Outsourced Services
Where accommodation, transport, or other services are provided by third parties (“Service Providers”), Project Laut Diving acts solely as an agent. Any dispute regarding outsourced services must be taken up directly with the Service Provider under their own terms and conditions.
14. Limitation of Responsibility
Guests acknowledge that Project Laut Diving shall not be liable in contract or tort for injury, damage, loss, delay, additional expense, or inconvenience caused directly or indirectly by us or by circumstances beyond our control, including but not limited to: war, civil disturbance, theft, delays, severe weather, Acts of God, Acts of Government, accidents to or failure of machinery/equipment/vehicles, or industrial disputes.
We are not liable for dissatisfaction based on personal opinion regarding service standards, nor for disappointment, distress, or lack of enjoyment arising from any act or omission whatsoever.
We will investigate justified complaints in writing relating to specific and tangible inadequacies of facilities or services provided directly by us. Complaints must be submitted in writing within 7 days to allow remedial action at the time.
15. Complaints Procedure
If something is not right, you agree to notify staff immediately so we can attempt to resolve the issue on the spot. If the staff present cannot resolve the issue, request to speak with management.
Formal complaints must be lodged in writing within 7 days and should include dates, names, and a clear factual description.
16. Other Items
- We guarantee the number of dives booked; however, specific dates, times, sites, and marine life encounters are not guaranteed. References to these are guidance only and do not constitute guarantees.
- You are responsible for notifying us promptly of any changes to your booking details. We are not responsible for problems caused by failure to follow our instructions or documentation requirements.
- Rates include taxes unless otherwise stated. Rates may change without prior notice and are only guaranteed once payment is received.
- It is your responsibility to avoid impossible or unsafe bookings (for example, booking courses you are not eligible for or diving less than 18 hours before flying).
- If there is an error in price or detail shown on our website or communications, we reserve the right to revise the terms in the spirit of mutual satisfaction and/or cancel the contract relating to that error without liability.
